Please find below our General Terms and Conditions. These always apply when you use or place an order on our website. They contain important information for you as a Buyer. Please read them carefully. We also advise you to save or print these conditions so that you can read them again at a any time.

Orders

The online shop of Atelier Pierre is open 24 hours a day. The website may be temporarily unavailable due to maintenance. You must be 18 years old and have a valid credit card to shop on our website. If you are under the age of 18, you can have an adult complete the order for you.

The AP webshop is intended for individual buyers only. Purchased products can therefore not be resold for business purposes.

ARTICLE 1: General provisions

This e-commerce website of Atelier Pierre, a private company with its registered office at Ambachtenlaan 10 - 8560, Wevelgem, listed in the Crossroads Bank for Enterprises (CBO) under the number: 0881.947.754 , offers its customers the opportunity to purchase the products from its webshop online.

§  The Customer: the natural person who, not acting in the exercise of a profession or business, enters into an Agreement with Atelier Pierre;

§  Overeenkomst: any arrangement or agreement between Atelier Pierre and the Customer, of which the General Terms and Conditions form an integral part of the Agreement.  

§  General Terms & Conditions: the subject General Terms & Conditions. 

§  Right of revocation: the possibility for the Customer to revoke the contract within a revocation period of 14 days.  

 

ARTICLE 2: Application of the General Terms & Conditions

§  All offers, agreements and deliveries by Atelier Pierre are subject to the General Terms and Conditions, unless explicitly agreed otherwise in writing.   

§  If the Customer includes in his order, confirmation or communication containing acceptance, conditions or provisions that deviate from, or do not appear in the General Terms and Conditions, these are only legally binding for Atelier Pierre if, and to the extent that they have been explicitly accepted in writing by Atelier Pierre.  

§   If specific product or service conditions apply in addition to the General Conditions, those conditions also apply, but in the event of conflicting conditions, the Customer may always rely on the applicable provision that is most favorable to him. 

 

ARTICLE 3: Prices 

All prices stated are in EURO, always including VAT, UNLESS stated otherwise on the website. 

For a shipment with a total value below € 100, a standard shipping cost of € 8 will be charged.

The stated price refers exclusively to the articles as described in words. The accompanying photos are for decorative purposes and may contain elements not included in the price or range.

Price indications and price changes are handled with the greatest possible care. In the event of an apparent error in the price display, we always reserve the right to unilaterally cancel the order. We make every effort to reduce such human and system errors to zero.

 

ARTICLE 4: Product range

Despite the fact that the e-commerce website is created with great care, it is possible that the information offered is incomplete, contains material errors, or is not up-to-date. Obvious mistakes or errors in the offer do not legally bind Atelier Pierre. We are, as regards the accuracy and completeness of the information offered, only bound by an obligation of means. Atelier Pierre is in no case liable in the event of manifest material errors, typesetting or printing errors.

If the Customer has specific questions about e.g. sizes, colour, availability, delivery period or delivery method, we request the Customer to contact our customer service department in advance (via hello@vanhalst.be)

The offer is always valid while stocks last and may be amended or withdrawn by Atelier Pierre at any time. We cannot be held liable for the unavailability of a product. If an offer has a limited period of validity or is made subject to conditions, this will be explicitly stated in the offer.

 

ARTICLE 5: Online purchases

The product range can be found by the Customer at www.atelierpierre.be / www.atelier-pierre.be.  The Customer can select items and place them in a non-binding virtual shopping basket. After the Customer has made his final selection, he can proceed with an effective order. Before making the final payment, the customer can check his order. Payment is made using a secure online payment system by means of Bancontact, Mastercard or Visa.

After submitting your order, you will receive a confirmation e-mail containing the details of your order.

Atelier Pierre may refuse an order in the event of a serious fault on the part of the Customer, regarding other orders involving that customer.

 

ARTICLE 6: Delivery and performance of the Agreement 

After the Customer’s order is received & paid for, the goods will be shipped within a reasonable period. Usually, this delivery period is set at 3 - 5 days. Please note that it may take 1 - 3 working days for your order to exit our warehouse, as it only leaves, once your payment has been received. Returns are always paid for by the customer.

Items ordered via this webshop are only delivered in Belgium.

Delivery is carried out by an Atelier Pierre chosen transport company, namely GLS.

For all orders with a value below €100, a standard shipping cost of €8 will be charged.

Any visible damage and / or qualitative defect of an item or deficiency in delivery must be reported by the Customer to Atelier Pierre at hello@vanhalst.be.

The risk due to loss or damage passes to the Customer as soon as he (or a party designated by him, who is not the carrier) has physically received the goods.

 

ARTICLE 7: Right of ownership

The delivered goods remain in our property until full payment of the price, including all costs and charges, has been made. However, the risk due to loss or damage already passes to the customer as soon as the goods are delivered or taken possession of.

 

ARTICLE 8: Right of revocation

In the context of remote sales to consumers, this right applies to customers who purchase items online from Atelier Pierre in their capacity as consumers.

The customer has the right, within a period of 14 calendar days without stating reasons, to revoke the Agreement and return their order.

The revocation period expires after 14 calendar days.

 

How do you exercise this right of revocation as a Customer?

The consumer must inform Atelier Pierre (Ambachtenlaan 10, 8560 – Wevelgem – +32 56 43 10 00 – hello@vanhalst.be) of his / her decision to revoke from the contract by means of an unequivocal statement (e.g. in writing by post or e-mail). The customer may use the attached form of revocation for this purpose, but is not obliged to do so.

The customer must return or hand over the items to Atelier Pierre within 14 calendar days of the day on which he communicates his decision to withdraw from their contract with Atelier Pierre. The customer is on time if he returns the goods before the period of 14 calendar days has expired.

 

The direct cost of returning the goods will be financed directly by the customer.

If the returned item is depreciated in any way, Atelier Pierre may hold the customer liable and claim compensation for any reduction in the value of the goods resulting from the customer's use of the goods beyond what is necessary to establish the nature, characteristics and functioning of the goods.

 

If the customer decides to withdraw from the contract, Atelier Pierre will at that time refund the payment received, excluding standard delivery costs and possible compensation for damages, to the customer within a maximum of 14 calendar days. This will be done using the same means of payment with which the customer made his original transaction, unless the customer has explicitly agreed otherwise. No additional costs will be charged.

ARTICLE 9: Warranty

This article applies only to a Customer who is not acting in the exercise of his profession or business.

Atelier Pierre guarantees that all the products comply with the Agreement, the specifications stated in the offer, the reasonable requirements of soundness and / or usability and the statutory provisions and / or government regulations existing on the date of conclusion of the Agreement.

If the delivered product does nog comply with the Agreement, the Customer must inform Atelier Pierre within a period of 2 years, from the moment the product was received by the customer. Thereafter, our customer service department will make an initial assessment of the product and our decision will be communicated within 14 days of receiving the complaint.

If Atelier Pierre finds this complaint justified, the relevant products will be repaired, replaced or reimbursed after consulting the Customer. The maximum compensation, subject to the Article on liability, is equal to the price paid by the Customer for the product (excluding shipping costs).

This warranty is not valid if/when:  

§  Intentionally inflicted damage; 

§  Improper use or lack of maintenance; 

§  Changes or repairs are carried out by the Customer himself or a third party without Atelier Pierre's consent. 

§  Natural and / or normal wear & tear;

§  Failure to follow (correctly) the instructions for use;  

§ The defectiveness is entirely or partially the result of regulations imposed or to be imposed by the government regarding the nature or quality of the materials used.

Mon - Thurs: 9 am -  12 pm & 1 pm - 5 pm

Fri: 9 am - 13 pm

 

ARTICLE 11: Privacy

When placing an order on the Atelier Pierre website, you, the Customer, consent to the processing and use of his / her personal data for the following purposes:

§  To optimize our website;

§  To keep you informed of updates on our platforms;

§  To keep you informed about our products and services;

§  For marketing purposes;

§  To provide you with efficient access to our website and services;

§  For the detection of fraud and improper use. 

This information is only used internally and is not passed on to other organisations for commercial purposes. The Customer may oppose processing for direct marketing purposes at any time, free of charge.

ARTICLE 12: Use of cookies

During a visit to our website, 'cookies' may be placed on the hard disk of your computer. These cookies are not used to identify individuals, a cookie can only identify a machine.
